1. Premises and Station Description
Owner agrees to rent to Renter one (1) designated booth / station / chair described as:

The premises are located within Owner's licensed cosmetology establishment at the address above (the "Salon").
Renter may use the assigned station for the practice of cosmetology, barbering, esthetics, manicuring, or natural hair styling services within the scope of Renter's current Alabama license. Renter has inspected the station and accepts it in its present condition.
2. Term
The initial term of this Agreement begins [[Start Date]] and continues on a [[month-to-month / fixed term of X months]] basis (the "Term"). Either party may terminate as provided in Section 11. Upon expiration of any fixed term, this Agreement automatically converts to month-to-month unless a new written agreement is signed.
3. Rent and Payment Terms
Renter shall pay Owner rent in the amount of $[[Flat Monthly Booth Rent or "XX% of gross receipts from services performed at the station"]] , due on the [[Due Day, e.g. the 1st]] of each month.

Renter is solely responsible for collecting payment from clients, collecting and remitting Alabama sales tax on taxable services and retail products sold, and reporting all income. Owner does not withhold or pay employment taxes for Renter.
4. Independent Contractor Status (Critical)
Renter is and shall remain an independent contractor and not an employee, partner, joint venturer, or agent of Owner. This Agreement does not create an employment relationship under Alabama or federal law.
Renter has the right to:
- Set Renter's own hours of operation (subject to the Salon's posted business hours and any reasonable common-area rules)
- Determine Renter's own service prices (within professional standards and required disclosures)
- Choose which clients to serve
- Select techniques, products, and methods (subject to Alabama Board rules and any shared product policy)
- Engage assistants or subcontractors only with Owner's prior written consent and at Renter's sole cost and liability
Renter is solely responsible for:
- All federal, state (Alabama), and local taxes including self-employment taxes and estimated payments
- Obtaining and maintaining Renter's own professional liability insurance
- Any required local business licenses or permits for independent operation
- Providing Renter's own primary tools, equipment, and supplies not expressly included
Owner shall not control the manner, means, or details of how Renter performs services. Owner provides the leased space and common facilities only.
5. Licenses, Insurance, and Compliance with Alabama Law
Renter represents and warrants that Renter holds a current, valid license issued by the Alabama Board of Cosmetology and Barbering (ABOC or ABOCB) in the appropriate classification(s) and will maintain it in good standing throughout the Term. License types include cosmetologist, barber, esthetician, manicurist, and natural hair stylist.
License Posting and Display (Alabama): Per Alabama Board rules, the Salon shop license and each individual practitioner's license must be conspicuously posted and visible to clients and inspectors. Renter shall post Renter's current personal license at or near the workstation at all times services are offered.
Renter shall maintain professional liability (malpractice) insurance with minimum coverage of $[[1,000,000 per occurrence / $2,000,000 aggregate]] or such higher amount as required by law or prudent practice. Renter shall provide Owner a certificate of insurance upon request.
Renter shall comply with all Alabama statutes, Alabama Board of Cosmetology and Barbering administrative rules (Chapter 250-X), sanitation and disinfection standards, scope of practice, and any local health department requirements. Owner maintains the establishment (shop) license and is responsible for common areas and overall Salon compliance. Renter is responsible for compliance at the assigned station.
Note on Shop Licenses for Booth Renters: If Renter operates under a separate business name or brand in a distinct suite and holds themselves out as an independent salon, Alabama Board guidance may require Renter to obtain a separate shop license. Renter is responsible for confirming this with the Board before operating under a separate name.
6. Use of Premises, Common Areas, Utilities, and Sanitation
Renter may use the assigned station and reasonable access to common areas (reception, restrooms, dispensary, break area) during Salon business hours.

Renter shall:
- Keep the station clean, sanitary, and professional at all times
- Follow all posted sanitation and disinfection protocols using only EPA-registered hospital-grade disinfectants with correct contact times
- Dispose of single-use items and biohazard materials per Alabama Board and local rules
- Not alter the station or add permanent fixtures without Owner's prior written consent
Owner shall maintain structural elements, common areas, and building systems in good repair.
7. Client Records, Ownership, and Non-Solicitation
Client Ownership: All clients serviced by Renter at the station are Renter's clients. Renter owns the client relationship and associated service records for those clients.
Renter shall maintain accurate client records as required by the Alabama Board, including service history, products used, and contraindications. Upon termination, Renter may take copies of Renter's client records (subject to any legal retention requirements for the Salon).
Non-Solicitation: During the Term and for [[60-90 days]] after termination, Renter shall not actively solicit clients known to Renter solely through the Salon relationship to provide services at another location, to the extent enforceable under Alabama law. Clients who independently follow Renter are not restricted.
8. Products, Supplies, and Retail Sales
Renter may use Renter's own professional products and retail inventory. Products supplied by Owner (if any) will be noted separately: [[e.g. "Backbar supplies billed at cost; retail inventory purchased by Renter"]].
Renter is solely responsible for collecting and remitting Alabama sales and use tax on services and retail product sales. Owner may require use of a shared POS system for sales tracking.
Renter shall not use or sell any products prohibited by the Alabama Board, FDA, or applicable law.
9. Conduct, House Rules, and Quiet Enjoyment
Renter shall conduct business professionally, respect other renters, staff, and clients, and not create a nuisance or interfere with others' rights in the Salon.
Renter agrees to comply with the Salon House Rules attached as Exhibit A, as reasonably updated by Owner with notice.
10. Insurance, Liability, and Indemnification
Owner's insurance covers the building and common areas only. Owner does not insure Renter's tools, products, personal property, or client claims arising from Renter's services.
Renter shall indemnify, defend, and hold harmless Owner from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Renter's negligence, willful misconduct, breach of this Agreement, or services provided.
11. Termination
Either party may terminate this month-to-month Agreement by providing [[30]] days' written notice.
Owner may terminate immediately for material breach, including but not limited to: loss or suspension of required license, failure to maintain insurance, violation of Board rules endangering clients or the shop license, non-payment after notice, or illegal activity.
Upon termination, Renter shall:
- Remove all personal property within [[7]] days
- Leave the station clean and in good condition (normal wear excepted)
- Return keys, access devices, and Owner property
- Settle any outstanding rent or charges
12. Default and Remedies
If Renter fails to pay rent when due or materially breaches this Agreement and fails to cure within any applicable notice period under Alabama law, Owner may pursue all remedies available, including termination and recovery of possession, unpaid amounts, and damages.
13. Notices
Notices shall be in writing and delivered by hand, certified mail, or email with read receipt to the addresses in this Agreement. Notice is effective upon receipt or three business days after mailing, whichever is earlier.
14. Governing Law, Severability, and Entire Agreement
This Agreement is governed by the laws of the State of Alabama. Disputes shall be resolved in the courts of [[County, Alabama]].
If any provision is held invalid, the remainder remains in full force.
This Agreement, including exhibits, constitutes the entire agreement and supersedes prior discussions. Amendments must be in writing and signed by both parties. Electronic signatures are accepted.
